Decree of Dissolution of Marriage - "Based on the vocational evaluation and testimony by Dr. Robert S. Barkhaus and in spite of the fact that the respondent had been found to be disabled by the Social Security Administration and awarded benefits beginning in 1998, the Judge stated in his ruling on November 11, 2004 "The issue is not whether Respondent is disabled and unable to work, but rather, whether Respondent is incapacitated to the extent that Respondent's ability to support himself is materially affected. As the Supreme Court noted in Cannon v. Cannon, 758 N.E. 2d 524, 527 (Ind. 2001):
When a trial court finds that a spouse is physically or mentally incapacitated to the extent that the ability of that spouse to support himself or herself is materially affected, the trial court should normally award incapacity maintenance in the absence of extenuating circumstances that directly relate to the criteria for awarding incapacity maintenance.
The Court does not find the Respondent is incapacitated to the extent that his ability to support himself is materially affected."" |
