The Process
The evaluation process begins by the attorney retaining the Vocational Expert for his client. The attorney furnishes the Vocational Expert all relevant background information for review and study by the Vocational Expert. This information usually includes the medical/psychological documentation relating to the individual's ability to engage in the physical, mental, or social aspects of work.
Functional Capacity Evaluations are sometimes helpful to the Vocational Expert in understanding the exertional capabilities and restrictions of the individual. Tax filings, personnel files, educational documents, and other relevant information may also be reviewed by the Vocational Expert.
For most evaluations the Vocational Expert will want to interview the individual. The interview is followed by a discussion with the attorney, who may request a report and/or testimony at a deposition and/or trial.
